1. Ownership & Intellectual Property
Ownership. All content on the PromoGrade platform — including but not limited to assessment center exercises, exercise scenarios, grading rubrics, standards content, evaluation prompts, individual and agency reports, practice library documents, methodology documentation, website design, software, text, graphics, and logos — is the exclusive property of Davis Group Development LLC (d/b/a PromoGrade). All rights are reserved.
Limited license. Subject to your compliance with these Terms, PromoGrade grants you a limited, revocable, non-exclusive, non-transferable license to access and use the platform solely for the purpose for which access was granted: administering assessments (agency clients), reviewing results (agency clients and candidates), or preparing for a promotional examination (individual candidate users).
Prohibited uses. You may not, and may not permit any third party to: (a) copy, reproduce, republish, distribute, publicly display, or sell any content obtained from the platform, in whole or in part; (b) modify, translate, or create derivative works based on platform content; (c) use platform content to train, fine-tune, or evaluate any machine learning model or artificial intelligence system, whether commercial or non-commercial; (d) use platform content to create a competing product or service; (e) reverse engineer, decompile, or attempt to extract source code, algorithms, or underlying rubric structure of any platform component; (f) remove or alter any copyright, trademark, or other proprietary notice on any content; (g) scrape, crawl, or use automated tools to extract content from the platform.
Consequences. Violation of this section constitutes a material breach of these Terms and will result in immediate termination of your account, forfeiture of any prepaid fees, and may subject you to legal action for injunctive relief and damages, including statutory damages under U.S. copyright law of up to $150,000 per infringed work plus attorneys' fees and costs. © 2026 PromoGrade · Davis Group Development LLC. 2. Permitted Use
You may use PromoGrade solely for its intended purpose: preparing for or administering public safety promotional assessments. You may not copy, resell, sublicense, scrape, reverse-engineer, or repurpose any content or functionality of this platform for commercial or personal gain outside your authorized use.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree not to share your login with others. PromoGrade reserves the right to suspend or terminate accounts that violate these terms.
4. AI-Generated Content
PromoGrade uses artificial intelligence to transcribe and grade practice sessions. AI-generated scores and feedback are intended as practice tools only and do not constitute official evaluations, employment decisions, or professional assessments. PromoGrade makes no guarantees regarding the accuracy of AI-generated results.
5. Payments & Refunds
All purchases are final. Credits purchased are non-refundable once used. Unused credits may be eligible for refund within 30 days of purchase by contacting us directly. Advertising fees are non-refundable after a campaign has been activated.
6. Recordings & Data
By submitting a recording through PromoGrade, you grant PromoGrade a limited license to process, transcribe, and analyze that recording solely for the purpose of generating your graded feedback. Recordings are not shared publicly or sold to third parties.
7. Disclaimer of Warranties
PromoGrade is provided "as is" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or that results will meet your expectations.
8. Limitation of Liability
To the fullest extent permitted by law, PromoGrade shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to lost profits, loss of data, or employment outcomes.
9. Governing Law
These Terms are governed by the laws of the State of Ohio. Any disputes shall be resolved in the courts of Hancock County, Ohio.
10. Changes to These Terms
PromoGrade reserves the right to update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the updated Terms.
