You may use PromoGrade solely for its intended purpose: preparing for or administering public safety promotional assessments. You may not copy, resell, sublicense, scrape, reverse-engineer, or repurpose any content or functionality of this platform for commercial or personal gain outside your authorized use.

You are responsible for maintaining the confidentiality of your account credentials. You agree not to share your login with others. PromoGrade reserves the right to suspend or terminate accounts that violate these terms.

PromoGrade uses artificial intelligence to transcribe and grade practice sessions. AI-generated scores and feedback are intended as practice tools only and do not constitute official evaluations, employment decisions, or professional assessments. PromoGrade makes no guarantees regarding the accuracy of AI-generated results.

All purchases are final. Credits purchased are non-refundable once used. Unused credits may be eligible for refund within 30 days of purchase by contacting us directly. Advertising fees are non-refundable after a campaign has been activated.

By submitting a recording through PromoGrade, you grant PromoGrade a limited license to process, transcribe, and analyze that recording solely for the purpose of generating your graded feedback. Recordings are not shared publicly or sold to third parties.

PromoGrade is provided "as is" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or that results will meet your expectations.

To the fullest extent permitted by law, PromoGrade shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to lost profits, loss of data, or employment outcomes.

These Terms are governed by the laws of the State of Ohio. Any disputes shall be resolved in the courts of Hancock County, Ohio.

PromoGrade reserves the right to update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the updated Terms.

PromoGrade ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains what information we collect, how we use it, and your rights regarding that information.

We collect the following types of information:

• Account information — name, email address, and password (stored as a secure hash) when you create an account
• Agency information — department name, agency type, and position details provided during setup
• Payment information — processed securely by Stripe. PromoGrade does not store credit card numbers
• Audio/video recordings — submitted voluntarily for AI grading
• Usage data — pages visited, features used, and session activity for platform improvement
• Contact form submissions — name, email, and message content when you contact us

We use your information to:

• Provide, operate, and improve the PromoGrade platform
• Process payments and manage your account
• Transcribe and grade your practice session recordings using AI
• Respond to inquiries and provide customer support
• Send important account and service notifications
• Comply with legal obligations

We do not sell, rent, or trade your personal information to third parties for marketing purposes.

Audio and video recordings you submit are processed by AI transcription and grading services (including OpenAI Whisper and Anthropic Claude) solely for generating your practice feedback. Recordings are not shared publicly, sold, or used to train external AI models without explicit consent. Recordings may be retained for a limited period to support grading accuracy and dispute resolution.

We use the following third-party services, each with their own privacy policies:

• Supabase — database and file storage
• Stripe — payment processing
• Anthropic Claude — AI grading and feedback
• OpenAI Whisper — audio transcription
• Vercel — platform hosting

We implement industry-standard security measures including encrypted data transmission (HTTPS), hashed password storage, and access-controlled databases. No method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

We retain your account data for as long as your account is active. You may request deletion of your account and associated data at any time by contacting us. Recordings may be retained for up to 90 days after grading for quality assurance purposes.

You have the right to:

• Access the personal data we hold about you
• Request correction of inaccurate data
• Request deletion of your data
• Opt out of non-essential communications
